The frame
The legal and institutional framework governing PPPs in the Democratic Republic of Congo.

Legal framework
Law No. 18/016 of July 9, 2018 established a legal framework to promote PPPs as a key tool for financing public infrastructure including the conclusion, execution, monitoring and control of PPP contracts, dispute resolution, tax, customs and parafiscal regime and the obligations of the contracting parties.
Decree No. 21/04 of October 2, 2021 concerns the creation, organization and operation of a public technical and administrative establishment responsible for supporting the Congolese State and the contracting authorities in the design, validation and monitoring of PPP projects: the Public-Private Partnership Advisory and Coordination Unit, UC-PPP.
Decree No. 23/38 of October 26, 2023 , the missing link between Law No. 18/016 of 2018 and its concrete implementation, concerns the implementing procedures of Law No. 18/016 of July 9, 2018, relating to Public-Private Partnerships. This decree operationalizes the PPP law by defining the rules, procedures, and bodies involved in the validation, monitoring, and control of PPP projects.
Institutional framework
The Public-Private Partnership Advisory and Coordination Unit, UC-PPP for short, is a public establishment of a technical and administrative nature, endowed with legal personality and management autonomy under Decree No. 21/04 of October 2, 2021. Placed under the supervision of the Minister of Planning and Coordination of Development Aid, it has its headquarters in Kinshasa, Capital of the Democratic Republic of Congo.
